Winning Strategies to Successfully Mitigate and Resolve Agency and Investor Repurchase Demands

Between 2018 and much of 2022, our industry had experienced a welcome reprieve from the onslaught of new mortgage repurchase and make-whole demands that were made by the Agencies and Investors. However, with our industry now suffering from rising interest rates and a softening of demand, there has been a rapid resurgence of repurchase and make-whole demands being made by the likes of the FDIC (WaMu), Ginnie Mae, Wells Fargo, Freddie Mac, Fannie Mae, and many more. 
 
In an effort to help our Members and lenders around the country defend themselves against this resurgence in repurchase and make-whole demands, we have enlisted industry veteran attorney, James Brody, a Senior Partner with Garris Horn LLP, who will provide invaluable information and advice that can be used to defend against such demands, mitigate any potential losses on those demands that cannot be defended outright, and to recover any potential losses from those 3rd parties that may have caused the problems that led to such demands being made.
 
Some of the many issues that will be covered in this live session, include, but are in no way limited to, the following:
 
• Insightful analyses into the various state and federal laws that govern the resolution of buy-back and indemnification demands
• Recommended processes for internally managing agency and investor demands
• An examination of the critical language contained within various Loan Purchase Agreements and Sellers Guides
• Strategies with which to respond to specific allegations made in support of agency and investor demands (e.g., occupancy, valuation, etc.)
• 3rd Party mitigation strategies in order to recoup actual and estimated losses (e.g., pursuing appraisers, brokers, borrowers, settlement agents, title companies, insurance carriers, etc.)
• Tips to negotiating new, as well as renegotiating current, correspondent loan purchase agreements and sellers guides
• Setting reserves and planning ahead
